2. The Information Regulator's guide
The Information Regulator has published a guide on how to use PAIA and POPIA (section 10 of PAIA). It is available in each official language from the Information Regulator (South Africa), inforegulator.org.za.
3. Records available without a request
Everything published on Who Serves, including the complete record in machine-readable form at /data/roll.json, is available to anyone without a PAIA request (section 52).
4. Records we hold
- The public record and its sources, and the history of changes to it;
- submissions made through the "Is this you?" form, and correspondence;
- records of coffee payments (reference, amount, fees and status);
- company, financial, tax and operational records;
- technical records, including security logs.
5. How to request a record
Send a request using Form 2 of the Regulations Relating to the Promotion of Access to Information, 2021 (available from the Information Regulator) to queries@whoservessa.com. Say which record you want, the form of access you want, and the right you want to exercise or protect and why the record is needed for it (section 53). If you are asking on someone else's behalf, include proof of your authority.
We will reply within 30 days (which may be extended once by up to 30 days in the circumstances section 57 allows). Fees, if any, are those prescribed by the Regulations; a requester asking for their own personal information does not pay the request fee.
6. Grounds for refusal
We may refuse access only on the grounds in Chapter 4 of Part 3 of PAIA — for example, to protect the privacy of a third party (section 63), commercial information of a third party (section 64), confidential information (section 65), the safety of individuals and property (section 66), privileged legal records (section 67) or our own commercial information (section 68). If we refuse, we give reasons and tell you how to challenge the decision: a complaint to the Information Regulator or an application to court (sections 77A and 78).
7. Processing of personal information
- Purposes: publishing a public-interest record of public office-holders; keeping it accurate; dealing with correspondence and submissions; receiving voluntary contributions; operating and securing the site.
- Data subjects and categories of information: office-holders (information about their public office, declared interests, qualifications and accountability records, and official office contact details); correspondents and submitters (names, roles, email addresses, messages, and hashed IP addresses); contributors (payment references and amounts); visitors (technical data processed by our hosting provider).
- Recipients: the public (the published record only); our operators Cloudflare, Google (web fonts), our email provider and PayFast; authorities where the law requires.
- Transfers across borders: some operators process information outside South Africa, as described in the privacy policy.
- Security: as described in the privacy policy.
